1. Safe Harbor Statement
Luma Player operates in compliance with the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512, and equivalent copyright legislation in other jurisdictions. Luma Player qualifies as a "Service Provider" within the meaning of 17 U.S.C. § 512(k) and claims the protections afforded by the DMCA safe harbor provisions.
As a neutral software application, Luma Player:
- Does not host, store, cache, or archive any audio or video content
- Does not upload, transmit, or broadcast any media to users
- Does not select, curate, recommend, or have knowledge of the content accessed by its users
- Does not receive any financial benefit directly attributable to any infringing activity
- Acts solely as a local rendering engine for URLs and streams provided entirely by the end user
All media content accessed through Luma Player originates from external servers and URLs configured solely and independently by the user. Luma Player has no control over, and no awareness of, what content users choose to access through the application.
2. Our Commitment to Copyright Compliance
Luma Player respects the intellectual property rights of others and expects its users to do the same. We are firmly committed to complying with all applicable copyright laws and responding promptly to legitimate notices of alleged infringement.
In accordance with the DMCA and our internal policies, Luma Player will:
- Respond expeditiously to valid DMCA takedown notices
- Terminate or disable access for users who are determined to be repeat infringers
- Accommodate and not interfere with standard technical measures used by copyright owners to identify and protect their works
- Cooperate fully with rights holders and legal authorities in any investigation relating to copyright infringement
3. Repeat Infringer Policy
In accordance with 17 U.S.C. § 512(i), Luma Player maintains a clear policy of terminating, in appropriate circumstances, the access of users who are determined to be repeat infringers of copyright. Users who repeatedly use the application to access or distribute content in violation of copyright law may have their access to the application terminated.
4. How to Submit a DMCA Takedown Notice
If you are a copyright owner, or are authorised to act on behalf of a copyright owner, and you believe that content being accessed through Luma Player infringes upon your copyright, you may submit a written notification to our Designated Copyright Agent. To be valid under the DMCA, your notice must include all of the following elements as required by 17 U.S.C. § 512(c)(3):
- Identification of the copyrighted work — A description of the copyrighted work or works that you claim have been infringed. If multiple works are covered by a single notification, provide a representative list.
- Identification of the infringing material — A description of the material that you claim is infringing and information reasonably sufficient to permit us to locate that material (e.g., a URL, server address, or stream identifier).
- Your contact information — Your full legal name, mailing address, telephone number, and email address.
- Good faith declaration — A statement that you have a good faith belief that use of the material in the manner complained of is not authorised by the copyright owner, its agent, or the law.
- Accuracy statement — A statement made under penalty of perjury that the information in your notification is accurate, and that you are the copyright owner or are authorised to act on behalf of the copyright owner.
- Your physical or electronic signature — The physical or electronic signature of the copyright owner or a person authorised to act on the copyright owner's behalf.

We aim to acknowledge all valid notices within 3 business days and act upon them as soon as reasonably practicable.
5. Counter-Notice Procedure
If you believe that material was removed or disabled as a result of a mistake or misidentification, you may submit a written counter-notice to our Designated Copyright Agent. To be valid under 17 U.S.C. § 512(g)(3), your counter-notice must include:
- Your physical or electronic signature
- Identification of the removed material — A description of the material that has been removed and the location at which it appeared before it was removed
- Good faith statement — A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification
- Your contact information — Your full legal name, mailing address, telephone number, and email address
- Consent to jurisdiction — A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if your address is outside of the United States, for any judicial district in which Luma Player may be found, and that you will accept service of process from the person who provided the original DMCA notification or their agent
Upon receipt of a valid counter-notice, we will forward it to the original complainant and inform them that the removed material may be restored after 10–14 business days, unless the complainant files a court action.
6. User Responsibility
Luma Player is a neutral software tool. The application does not select, curate, or recommend any content. Users are solely and exclusively responsible for:
- The content they choose to access through the application
- Ensuring that any content they access is licensed, authorised, or otherwise lawfully available to them
- Complying with all applicable copyright laws and the terms of service of any content provider they use
- Ensuring that any playlist or stream source they configure within the application does not infringe the intellectual property rights of any third party
Luma Player expressly prohibits the use of its application to access, store, or distribute content in violation of any applicable copyright law. Any user found to be doing so acts entirely at their own legal risk and responsibility.
7. No Endorsement of Infringing Use
Luma Player does not endorse, encourage, or facilitate access to copyright-infringing content in any form. The application is designed and intended solely for use with content that users have a legal right to access. The presence of features that allow users to enter external URLs or stream addresses does not constitute an endorsement of any particular use of those features.
Luma Player actively cooperates with rights holders and law enforcement authorities to address copyright infringement where it is brought to our attention through lawful channels.
